“性侵犯,” as defined by the Clery Act, is any sexual act directed against another person, without consent of the victim, 包括受害者没有能力给予同意的情况, 包括强奸, 被溺爱的人, incest and statutory rape.

“Domestic Violence” means a felony or misdemeanor crime of violence committed by a current or former spouse or intimate partner of the victim; a person with whom the victim shares a child in common; a person who is cohabitating with, or has cohabitated with, the victim as a spouse or intimate partner; a person similarly situated to a spouse of the victim under the domestic or family violence laws of the jurisdiction in which the crime of violence occurred; any other person against an adult or youth victim who is protected from that person’s acts under the domestic or family violence laws of the jurisdiction in which the crime of violence occurred.

“跟踪,” as defined by VAWA, means engaging in a course of conduct directed at a specific person that would cause a reasonable person to fear for the person’s safety or the safety of others; or suffer substantial emotional distress. “Course of conduct” means two or more acts, 包括, but not limited to, acts in which the stalker directly, 间接, or through third parties, 通过任何行动, 方法, 设备, 或者意味着, 遵循, 监控, 观察, 监视, 威胁, or communicates to or about a person, or interferes with a person’s property. 通情达理人是指与被害人在相似情况下具有相似身份的通情达理人.
